Lesbian co-mothers are not parents under Family Law Act, but can seek orders about the children: court

  1. Hi, my same-sex partner and I processed some parenting orders through the Brisbane Family Court (after some hassles)...but have recently been informed that some recent law changes mean both/either of us can be placed on the birth certificate, thereby overriding the orders I believe (and making them superfluous). This is also retrospective, I understand, so I as the co-mother can apply to go on our son's birth certificate even though he is two (haven't got around to that yet!). I only know about Qld in this case, not other states.
