I came across
this site by a law prof in the States which sets out some discussion amongst lawyers of the possible outcome of the challenge to Proposition 8 in California. The site also contains a useful link to an overall update on the case. One lawyer is clear that he thinks that the case is doomed, others are not so sure.
I am a San Francisco-based law library, with a former career at the California Supreme Court. I maintain a blog on Prop. 8 at prop8legalcommentary.blogspot.com. Legal scholars in California are, indeed, divided in opinion on the likely outcome of the litigation.

ReplyDeleteThanks for letting us know. I consider the whole process fascinating. In the California Marriage Case, most of the minority said in effect: "Let's leave it to the people to decide", whereas the majority said that the right to marry was a fundamental right, as one would expect it to be. I am curious to see what happens.
